Job Description

Key Responsibilities:

  • ­Represent injured workers at hearings before administrative bodies or workers' compensation boards.
  • ­Present evidence, witness testimonies, and arguments to support the injured worker’s claim.
  • ­Cross-examine opposing witnesses and present the case in a clear and effective manner.
  • ­Prepare and file motions, petitions, and other legal documents as needed for hearings or appeals.

Case Preparation :

  • Gather all relevant medical records, reports, and testimonies to build a strong case.
  • ­Collaborate with medical experts, legal teams, and vocational experts to prepare comprehensive reports.
  • ­Ensure that all documents and evidence are properly organized and submitted according to deadlines.

Client Communication :

  • ­Maintain regular communication with clients to inform them of the status of their case and upcoming hearings.
  • ­Explain the workers’ compensation process to clients, ensuring they understand their rights and responsibilities.
  • ­Provide advice on the potential outcomes of hearings and next steps.

Negotiation and Settlement :

  • ­Negotiate settlements or other favorable outcomes on behalf of clients, when possible.
  • ­Advise clients on settlement offers and discuss the pros and cons of settling versus going to hearing.
  • ­Represent clients in settlement conferences and negotiations.

Case Management :

  • ­Maintain and update case files and records, ensuring all information is up-to-date and accurate.
  • ­Manage a caseload of workers' compensation cases, ensuring timely progress and resolution.
  • ­Stay informed on workers’ compensation laws and regulations to effectively advocate for clients.

Appeals :

  • ­ If a case is not decided in favor of the client, prepare and file appeals to higher authorities or courts.
  • ­ Assist in the preparation of appellate briefs and handle any post-hearing motions.

Required Skills and Qualifications:

  • Education : A bachelor’s degree in a relevant field (such as law, business, or a related discipline) is preferred
  • Experience : 3-5 years’ experience in workers’ compensation claims including 2 years of experience participating in hearings
  • Knowledge of Workers' Compensation Laws : Strong understanding of workers' compensation laws, regulations, and legal procedures.
  • Communication Skills : Excellent verbal and written communication skills are essential for interacting with clients, witnesses, and administrative bodies.
  • Negotiation Skills : Strong ability to negotiate settlements and deal with opposing parties effectively.
  • Attention to Detail : Ability to manage large volumes of information, ensuring accuracy in documentation and filings.
  • Organizational Skills : Strong organizational skills to manage multiple cases and deadlines.
  • Problem Solving : Ability to think critically and strategically to navigate complex cases.

Work Environment:

  • This role may involve a mix of office work and travel to various hearings or legal proceedings.
  • May work closely with law firms, insurance companies, healthcare providers, and governmental agencies.
  • Occasional evening or weekend hours may be required to prepare for hearings or meet deadlines.
